I need a cake for today. Can I stop by to pick one up?
All of our cakes are baked fresh to order so we do not have any ready made cakes available for same day pick up/delivery. We request that orders be placed at least two weeks in advance.

 

 

 

 

How much are your cakes?
Our starting prices are listed under our links however, we can’t give an exact price until we have details such as design, number of servings, and flavors. We do recommend that you check our Serving Guide and Pricing page to see if we are within your budget.

 

 

 

Can I taste your cake before ordering?
We will gladly schedule a tasting for orders requiring 100+ servings. The tasting will include three of our standard flavor samples and fillings for two people. There is a $30.00 fee which is credited back to you should you proceed with the order of at least 100 servings.

 

 

 

How do I make a payment?
Your order is not confirmed until full payment has been made at least two weeks prior to the event date. You can mail us a check or schedule a time to stop by and pay with cash or credit. We can not accept credit cards over the phone or internet. Please read our Payments page for more information.

 

 

 

How can I get a hold of you?
The best way to reach us is right here, through our site. We usually reply to all emails within 24 hours if not sooner unless we are closed. If you call us and get a machine, please leave a message and we’ll call you back as soon as possible. We are not always at the desk and may be out delivering, assisting other customers or up to our elbows in flour.

For those who require a large cake with 150+ servings, are on a budget, but would still like a highly decorated cake, we suggest you order a three tiered decorated cake along with frosted sheet cakes which can be cut and served once the main cake is cut. When thinking about the design of your cake, please remember to keep in mind the number of servings you will be ordering. Please use the serving guide for an idea on how many servings each tier serves.

 

 

 

A 50% non-refundable deposit is due at the time you accept our quote in order to reserve your date. The remaining balance is due 30 days prior to the delivery date. If we do not receive your final payment within the allotted time frame, we will assume you have decided to cancel your order and we will open the date to other customers.

In addition to rental fees, rental deposits may also be required when renting our cake plateaus, fountains, and other items. This deposit will be fully refunded once the items are returned in the same condition as when they were rented. A rental agreement will be required.

We currently accept cash, check, Visa, Mastercard, Discover, and American Express. Checks are not accepted for orders due within one week. Please be aware that there is a $25.00 fee for any returned checks and you are responsible for any additional bank fees.

Please note that all sales are final. A partial store credit may be given on a case by case basis.


Mary’s Delicacies delivers throughout East County for a minimum fee of $1.00 per roundtrip mile. Delivery to other areas in the San Francisco Bay Area will require additional fees including tolls for bridges. On site set-up is also available for a fee.

Deliveries are scheduled when the orders are placed. Please make sure you will be available at the time scheduled since we run on a tight schedule with deliveries. If you will be traveling with the cake, we encourage you to have at least one other person along to help carry the cake and suggest that you use a vehicle with a flat surface and plenty of room such as a van or SUV. Please remember that we are not responsible for the cake once it has been delivered.

Square Tiers: Move in 2 in. from the outer edge and cut vertically, top to bottom. Slice and serve 1 in. pieces of cake. Now move
in another 2 in. and repeat process until the entire tier is cut.
Round Tiers: Move in 2 in. from the tier’s outer edge and cut a circle. Slice and serve 1 in. pieces from around the circle. Now move in another 2 in and cut another circle. Repeat process until the tier is completely cut. The center core of each tier and the small top tier can be cut into 4th, 6th, or more, depending on size.
Oval Tiers: Move in 2 in. from the outer edge and cut across. Slice and serve 1 in. pieces of cake. Now move in another 2 in., repeat process until the entire tier is cut. Hexagon Tiers: Move in 2 in. from the outer edge and cut across. Slice and serve 1 in. pieces of cake. Now move in another 2 in., repeat process until the entire tier is cut.
Heart Tiers: Divide the tiers vertically into 2 in. wide rows. Within rows, slice and serve 1 in. pieces of cake. Petal Tiers: Cut similar to round tiers as diagram shows.


Licensed Character Cakes

Due to copyright laws, Marys Delicacies is unable to make cakes using licensed characters (ie. Disney, Sesame Street, Nickelodeon..etc.) unless a copyright release has been received from the copyright owner. If you would really like to order a cake with licensed characters you have two options:

1) Contact the copyright owner to obtain a release for the one time use. Please note that this may take some time and may be very expensive.

2) Choose a cake design from DecoPac. DecoPac has hundreds of licensed character designs that we can legally create, the only requirement is that the cake be designed exactly as they have pictured. Feel free to visit www.decopac.com and let us know if you are interested in a specific design. Please give us at least two weeks notice since we do not have all designs in stock.

When searching online for ideas for your cake, you may run across countless galleries from bakeries with beautiful licensed character cakes but unfortunately these cakes were either made with the copyright release which can run in the thousands of dollars, or without the copyright owners consent (illegally). Please note that we can try to match the theme of your party as much as possible using colors and you may purchase accessories to place on the cake when you

get home.

More Information Regarding Copyrighted Characters

The following was taken from Carolyn at mycakeclass.com:

Character Pans/Character Images
All licensed character shaped pans, candy molds and cookie cutters are for consumer home use only. Stores/Shops/Decorators cannot make cakes, cookies or candies from licensed or copyrighted images and sell them to consumers.

These “mold-making” items are strictly prohibited from any type of commercial use since the licensor has neither the method to control the quality of the reproduction of the character nor the ability to earn royalties on sales of the “made” products. Free-hand or copies of character designs cannot be drawn or iced on top of a cake, cupcakes or cookies and sold for any type of commercial purpose. Once again, the licensor cannot control the quality & is not earning a royalty on the product created around their characters.

Specifically, creating any type of image that looks like a licensed character that then is sold for commercial purposes is prohibited unless there is a specific licensing agreement with the licensor for that product and royalties are paid each time the product is sold.

Additionally a customer cannot bring a character pan/mold they have bought or a toy topper for a cake to a decorator or store/shop, and ask them to make the cake/candy/cookie in exchange for money. This is considered the same thing as above, because money is exchanging hands without the licensor earning royalties.

Edible Images
A copyright protects an original work or creation and gives exclusive right to that work or creation to its author. Copyright law protects the author’s/creator’s work by prohibiting anyone else from using or profiting from that creation in any way without the owner’s permission.

In reproducing copyrighted figures, it does not matter if the character is drawn by hand, added using an image projector, or put on a cake with a computer cake machine. If the item carries a © or ® or symbol, then it is protected. Although most copyright materials will contain either © or ® or , U.S. law does not require it.

Can it really hurt?
The answer is yes. Some copyright holders may be satisfied with a cease & desist order, others could choose to file a lawsuit. Ignorance of these laws will not dismiss the suit, or get you out of trouble with a cease & desist order. The court could find you guilty and award financial damages plus attorney fees. The copyright owner can collect damages without having to prove that your infringement actually cost them monetary harm. Fines can vary. Some may only ask for a low fine but some well known companies are very aggressive in going after anyone and be as high as they feel their image use is worth.

How will they know?
In actuality they may never know if I were to do a copyrighted image on a cake. Some companies though do have legal teams dedicated to searching out their images being used with out permission. There are some well known companies who do focus on the cake decorators industry. In turn let me ask, how do I know you are not part of one of those legal teams who are testing me to do your image? I pride myself in my work, and running my business in a legal fashion. If you are part of a legal team looking for me to break the law, please rest assured its not going to happen at this place of business.

Why can you do a Character Image from the Deco Pac book?
Deco Pac has arranged to cover the cost of royalty fees for use of their products. Because of this the cakes MUST be recreated exactly as shown in the book.
